California Innocence Project director Justin Brooks blogged about this case previously here.
Today, Brian Banks, former football star and USC Trojan recruit, was exonerated….The “victim” recanted and admitted she lied at trial (the sex was actually consensual). She did not come forward earlier because she didn’t want to “give the money back”–meaning the settlement that she obtained from the school where the rape allegedly occurred. CONGRATS TO BRIAN AND JUSTIN!!!!!
Congrats, indeed !!
THIS HAPPENS ALL THE TIME! MY FATHER IS CURRENTLY GOING THROUGH THE SAME SITUATION AND HE IS IN PRISON ALTHOUGH THE ACCUSER WAS CAUGHT IN LIES OVER AND OVER AGAIN BUT SINCE MY FATHER IS AN AFRICAN AMERICAN MALE (ALTHOUGH HE WAS SUCCESSFUL, WELL SPOKEN, AND EDUCATED) THEY PUT HIM IN PRISON ANYWAY. HER LAWYER WAS EVEN CAUGHT DESTROYING EVIDENCE THAT COULDVE EXONERATED MY FATHER AND THE POLICE OFFICERS WERE ALSO SUPPORTING MY FATHER. THIS JUST GOES TO SHOW THE INJUSTICE IN OUR LEGAL SYSTEM AND THE LOSS OF MORALS THAT PEOPLE HAVE. THIS HURTS SO MANY PEOPLE, I DONT KNOW HOW WOMAN CAN DO THINGS LIKE THIS AND GO TO SLEEP AT NIGHT.
Arizona’s Courtney Bisbee falsely accused, wrongfully convicted and sentenced to 11 years flat time under Thomas / Aubuchon / Alexander’s reign for an alleged crime that never happened. Why hasn’t the “new evidence” proof of innocence been heard in an Arizona Court? If this can happen to Courtney, it can happen to anyone in Arizona with overzealous prosecutors who ignore established protocol, due process and fail to investigate. What does this say about justice in Arizona?
Father and brother (prosecutor’s star witness) of accuser created a Petition to Free Courtney Bisbee, stating here and in affidavits that this was a scam for money by the mother and brother/son to sue the Paradise Valley Unified School district — the wealthiest school district in Arizona. Congratulations to Brian and each and every person who listened and actually took the time to find the “TRUTH”, the facts to regain Brian’s freedom. He has paid an awful price, lost time, days, months and years sitting in a cell for a crime he was falsely accused of. I know that there are others incaracerated who should not be in prison also. My nephew, Rataja Pinola, is currently incarcerated in Tehachapi and has been in prison for 10 years. He has recently filed a motion with the Superior Court here in Santa Rosa, Sonoma County, to have DNA testing done that his lawyer would not do during his murder trial. An “Expert Witness”, testified for the prosecution regarding specific tattoo’s which helped convict Rataja, when the fact is that he does not have the tattoo’s which that witness testified under oath that he has on his forearms. We are attending the court dates for him and are praying that his motion will be granted to have the DNA testing done. It is a slow Legal System for him to fight for his right to be heard on the DNA request but we have hope. Brian’s story is very inspirational. Good luck to him in his new life–thank you for the Legal Team for believing in Innocence.
