Milke was originally convicted of murder for having her 4-year-old son killed. The conviction rested upon the testimony of a rogue cop, who claims she confessed to him, although there is no documented record of that confession, and Milke denies it ever happened. This officer had a history of substantial misconduct, and that record was withheld from the defense.
In a ruling just today – citing “egregious prosecutorial misconduct,” the Arizona Court of Appeals on Thursday ordered a Maricopa County Superior Court judge to dismiss murder charges against Debra Milke with prejudice, meaning they cannot be brought again.

The Debra Milke case is just the “tip of the iceberg”! “Milke’s attorneys maintained the (Maricopa County) attorney’s office was pursuing the case for purely political reasons” ch 5 PHX.
Imagine the precedent they set for the last 25 years, for future cases in the criminal justice system. If they could send a woman to death row, who did not kill her son, then they could do whatever they wanted to anyone else, that followed. Arizona doesn’t favor women, mothers or their rights.
Last week Harvard did a study that named Arizona #1 Corrupt state in the United States. What DOES that say about Arizona’s justice system?
I see Maricopa County come up a lot. I will probably never forget the case of Lisa Randall, which you can read about here:(http://www.azcentral.com/community/peoria/articles/2011/03/08/20110308peoria-woman-seeks-12-million-in-murder-case.html). Had her prosecution been successful – it’s likely it would have had Andrew Thomas remained in office – she may have been sentenced to death as well.
